Effective date: September 25, 2026
Last updated: September 25, 2026
These Terms of Use (the “Terms”) are a legally binding agreement between you and Kysliuk Dmytro Ivanovych, operating and publishing under the name Stupid Shark (“Stupid Shark,” “we,” “us,” or “our”).
These Terms govern your download, installation, access to, and use of any mobile game published by Stupid Shark that links to these Terms, including its software, gameplay, content, updates, in-app features, advertisements, purchases, customer support, and any related websites or services that link to these Terms (collectively, the “Services”).
Features differ between games. Provisions about accounts, cloud saves, advertisements, purchases, or online features apply only where the game offers them. A purchase description or additional terms presented for a particular feature may provide more specific conditions.
Please read these Terms carefully. By downloading, installing, accessing, purchasing through, or using any part of the Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not download, install, access, or use the Services.
Our Privacy Policy explains how information is collected, used, and shared in connection with the Services:
Privacy Policy: https://stupidshark.com/privacy-policy
1. Operator and contact information
The Services are published under the name Stupid Shark and operated by:
Legal name: Kysliuk Dmytro Ivanovych
Publishing name: Stupid Shark
Address: Babyn, Rivne Region, Ukraine
Email: support@stupidshark.com
2. Eligibility and minors
You may use the Services only if you are legally permitted to enter into these Terms under the laws applicable to you.
Our games are intended for the audiences identified in their respective store listings. Unless a particular game expressly says otherwise, our games are not directed to children under 13. If you are under the age at which you may independently consent to these Terms or make digital purchases in your country or region, you may use the Services only with the permission and supervision of a parent or legal guardian.
If you are a parent or legal guardian who allows a minor to use the Services, you agree to supervise the minor’s use of the Services and, to the extent permitted by applicable law, accept responsibility for the minor’s activity, including any purchases made through a device, platform account, or payment method under your control.
Parents and legal guardians should use the parental controls, purchase authentication settings, and family features made available by the relevant app store, operating system, or device provider.
3. Changes to the Services
We may develop, update, modify, balance, replace, restrict, suspend, or remove parts of the Services from time to time. This may include changes to:
-
gameplay mechanics, levels, difficulty, rewards, visual content, or user interface;
-
compatibility requirements;
-
advertisements or monetization features;
-
in-app products and prices;
-
technical systems, third-party integrations, or platform support;
-
features available in a particular country, region, device, or app version.
Some updates may be required for continued use of the Services. If you do not install a required update, some or all of the Services may stop working correctly or become unavailable.
We do not guarantee that every feature, level, purchase, advertisement, reward, or version of the Services will remain available permanently. Where required by applicable law, we will provide reasonable notice of material changes or discontinuation.
4. Limited license
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Services on a compatible device solely for your private, non-commercial entertainment.
The Services are licensed, not sold. Your license does not give you ownership of the Services, their source code, game content, intellectual property, in-app products, or any other materials made available through the Services.
The license granted under this section ends automatically when:
-
you permanently delete or uninstall the Services;
-
you materially breach these Terms;
-
we lawfully terminate your access to the Services; or
-
the Services are permanently discontinued.
All rights not expressly granted to you are reserved by us and our licensors.
5. Acceptable use and prohibited conduct
You must use the Services lawfully, fairly, and only for their intended purpose.
You must not, and must not encourage, assist, or attempt to allow another person to:
-
copy, reproduce, distribute, publish, sell, rent, lease, sublicense, or commercially exploit the Services or any part of them without our prior written permission;
-
reverse engineer, decompile, disassemble, decode, modify, translate, adapt, or create derivative works from the Services, except to the limited extent that applicable law expressly permits such activity despite this restriction;
-
access, extract, or attempt to obtain source code, private APIs, development assets, encryption keys, or other non-public technical information;
-
bypass, disable, interfere with, or circumvent technical protections, purchase verification, platform restrictions, security systems, advertising systems, or access controls;
-
use cheats, bots, scripts, macros, automation, modified clients, emulators used for abuse, exploits, unauthorized plugins, or other tools that alter or automate gameplay or interactions with the Services;
-
exploit bugs, errors, unintended behavior, reward systems, advertisements, purchases, or technical limitations for an unfair or unauthorized benefit;
-
fraudulently interact with advertisements, generate invalid traffic, automate ad views, manipulate rewarded advertisements, falsify attribution, or obtain rewards without legitimately satisfying the applicable conditions;
-
interfere with, damage, disrupt, overload, or impair the Services, our systems, an app store, an advertising provider, or any third-party service;
-
introduce malware, malicious code, corrupted data, denial-of-service activity, or any harmful technology;
-
scrape, crawl, data-mine, index, monitor, or systematically collect information from the Services using automated means without our written permission;
-
impersonate another person or entity, misrepresent your affiliation, or use the Services for fraud or deception;
-
use the Services in a way that infringes intellectual property, privacy, publicity, contractual, or other rights;
-
use the Services for unlawful, abusive, harmful, or unauthorized purposes;
-
remove, hide, or alter copyright, trademark, ownership, attribution, or legal notices; or
-
violate applicable laws, regulations, sanctions, app-store rules, or these Terms.
We may investigate suspected violations and take proportionate action, including restricting features, invalidating improperly obtained rewards, revoking improperly obtained purchase entitlements, suspending access, terminating the license, or reporting unlawful conduct to the relevant platform or authorities where appropriate.
6. Gameplay, progress, and local data
Different games may store progress and settings locally, through an account or cloud-save feature, or both. A game that offers cloud saving may have its own synchronization rules, technical limits, or restoration controls.
Locally stored information may be lost if you uninstall or clear app data, reset or replace a device, change platform accounts, encounter storage corruption, or experience a technical failure. Unless the applicable game expressly offers a cloud-save or account-based restoration feature, we cannot promise that local progress can be recovered or moved to another device.
If a game offers an account, you are responsible for keeping your login credentials secure and for activity through your account, except where applicable law provides otherwise. You must provide accurate information needed for the account and notify us if you suspect unauthorized access. Third-party sign-in methods may be governed by the provider’s separate terms.
Games may offer online events, leaderboards, social features, or other connected functionality. Specific rules or notices may apply to those features when offered. Details about the processing and deletion of account or cloud data appear in our Privacy Policy.
7. In-app purchases
The Services may offer paid digital products or features (“In-App Purchases”). These may include, for example:
-
removal or reduction of certain advertisements;
-
level packs or content unlocks;
-
cosmetic items;
-
gameplay-related features;
-
consumable or non-consumable digital items;
-
premium versions or upgrades; or
-
other digital content described on the applicable purchase screen.
The exact content, functionality, price, currency, duration, platform availability, and conditions of an In-App Purchase will be shown at or before the time of purchase.
7.1 Platform billing
In-App Purchases are generally processed by the app store or platform through which you obtained the Services, such as Google Play. The platform provider, not Stupid Shark, processes the payment method and may collect taxes, fees, or currency-conversion charges.
Your purchase is also subject to the platform provider’s terms, billing rules, refund policies, and purchase-authentication settings.
You are responsible for reviewing the purchase description and final displayed price before confirming a transaction.
7.2 License to digital products
An In-App Purchase gives you a limited, personal, non-transferable, non-sublicensable, revocable right to use the applicable digital product within the Services. Unless applicable law requires otherwise:
-
digital products are not your personal property;
-
they have no cash value outside the Services;
-
they cannot be redeemed for cash;
-
they may not be sold, transferred, traded, gifted, or exchanged outside functionality expressly provided by us;
-
they may be limited to the platform, account, device, or app version associated with the purchase; and
-
they remain subject to these Terms and the technical operation of the Services.
7.3 “Remove Ads” purchases
A game may offer a non-consumable purchase described as “Remove Ads,” “No Ads,” or similar wording.
The exact scope of this purchase is determined by the description displayed on the purchase screen. Unless that description states otherwise, a Remove Ads purchase is intended to remove or reduce automatically displayed third-party advertising, such as forced interstitial or banner advertisements, in the applicable game.
A Remove Ads purchase may not remove:
-
optional rewarded advertisements that you choose to watch in exchange for an in-game benefit;
-
Stupid Shark announcements or notices, cross-promotions, or links;
-
platform-provided content;
-
content that is not classified as advertising;
-
advertising displayed outside the Services; or
-
advertising in a materially different product or separate application.
The purchase applies only while it remains valid, recognized by the platform, supported by the applicable version of the Services, and not refunded, charged back, cancelled, or revoked.
7.4 Purchase restoration
Non-consumable purchases may be restorable through the relevant app store or an available in-game mechanism if you use the same platform account that made the original purchase and if the platform provides sufficient purchase verification.
Restoration may require an internet connection, an up-to-date application version, access to the original platform account, or use of a restore-purchase function where available.
We cannot guarantee restoration when the platform cannot verify the transaction, the purchase was refunded or reversed, you changed to an incompatible platform, or the applicable product is no longer technically supported.
7.5 Refunds and reversals
Refund eligibility is determined by applicable law and the policies of the app store or platform that processed the transaction. Where a purchase was made through Google Play or another third-party store, you may need to submit the refund request directly to that provider.
Nothing in these Terms limits any mandatory refund, cancellation, conformity, or consumer rights that cannot legally be waived.
If a transaction is refunded, reversed, charged back, cancelled, found to be fraudulent, or otherwise invalidated, we may remove or disable the corresponding digital product or benefit.
For purchase-related support, contact the relevant app store and, where appropriate, email us at support@stupidshark.com with the transaction details permitted to be shared. Do not send full payment-card information.
7.6 Unauthorized purchases
You are responsible for maintaining appropriate purchase authentication and device security. If you believe a purchase was made without authorization, contact the platform provider and your payment provider promptly and notify us where necessary.
This section does not make you responsible for unauthorized transactions where applicable law provides otherwise.
8. Advertising and rewarded advertisements
The Services may be supported by advertising supplied by us or third-party advertising partners. Advertisements may include banners, interstitial advertisements, video advertisements, playable advertisements, or optional rewarded advertisements.
A rewarded advertisement may offer an in-game benefit after the advertisement has been viewed or interacted with in the required manner. Rewards are subject to successful completion and technical verification.
We do not guarantee that:
-
a rewarded advertisement will always be available;
-
a particular advertisement will be shown;
-
an advertisement will function on every device or connection;
-
a reward will be available in every country, version, or session; or
-
an advertising provider will successfully confirm completion.
If a reward is not granted because of a temporary connection, provider, platform, or verification failure, we may attempt to provide reasonable support, but we do not guarantee restoration where completion cannot be verified.
You must not use automation, repeated fraudulent interactions, device manipulation, network manipulation, or other improper means to generate ad impressions, clicks, installs, attribution events, or rewards.
Third-party advertisers are responsible for the content of their advertisements and destination services to the extent provided by applicable law. An advertisement does not necessarily mean that we endorse the advertised product or service.
Information about advertising technologies and data processing will be described in our Privacy Policy:
Privacy Policy: https://stupidshark.com/privacy-policy
9. Third-party platforms and services
The Services may depend on or interact with third-party services, including:
-
app stores and payment processors;
-
operating systems and device services;
-
analytics, diagnostics, crash-reporting, remote-configuration, messaging, or advertising providers;
-
external websites;
-
customer-support tools; and
-
other technical service providers.
Your use of a third-party service may be governed by separate terms and privacy policies. We do not control and are not responsible for third-party services, their availability, security, content, billing decisions, advertising, policies, or practices, except where applicable law provides otherwise.
The Services may contain links that take you outside the application. You access external websites or services at your own discretion and should review their terms and privacy practices.
If a third-party platform suspends, changes, or terminates a service on which a game depends, some functionality may become unavailable.
10. Device, connectivity, and compatibility requirements
You are responsible for obtaining and maintaining a compatible device, operating system, internet connection, and any other equipment or services required to use the Services.
Your mobile operator or internet provider may charge data, roaming, or other fees. Stupid Shark is not responsible for those charges.
Performance and availability may vary depending on device model, available storage, memory, graphics hardware, operating-system version, network conditions, geographic location, app version, platform limitations, and other technical factors.
For safety, do not use the Services in a way that distracts you while driving, operating machinery, walking in dangerous areas, or performing any activity that requires your full attention.
11. Intellectual property
The Services and all associated materials are owned by Stupid Shark, Kysliuk Dmytro Ivanovych, or the applicable licensors and are protected by copyright, trademark, trade-secret, and other intellectual-property laws.
Protected materials include, without limitation:
-
software and source code;
-
game design and gameplay presentation;
-
levels and level arrangements;
-
graphics, artwork, models, textures, animations, interfaces, and visual effects;
-
music, sounds, and audiovisual content;
-
text, names, logos, icons, and branding;
-
documentation;
-
databases and compilations; and
-
updates, modifications, and derivative materials.
Stupid Shark, its games, their logos, and associated branding may be trademarks or trade names of their respective owner. No right to use a trademark, logo, domain name, social-media identity, or brand element is granted except as necessary for ordinary personal use of the Services.
You may capture and share ordinary screenshots or gameplay recordings for personal, non-commercial commentary, reviews, streaming, or fan discussion, provided that your use:
-
does not falsely suggest sponsorship, partnership, or endorsement;
-
does not distribute game files, source assets, or substantial standalone asset collections;
-
does not reveal or exploit confidential or unlawfully obtained material;
-
does not violate these Terms or applicable law; and
-
is removed if required by law or a valid rights-enforcement request.
Commercial use, merchandise, asset extraction, resale, or incorporation of our materials into another product requires prior written permission.
12. Feedback and suggestions
You may voluntarily send us ideas, suggestions, bug reports, comments, or other feedback about the Services (“Feedback”).
You retain ownership of any rights you lawfully hold in your Feedback. However, by submitting Feedback, you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, commercialize, and otherwise use the Feedback for any lawful purpose without compensation or obligation to you.
Do not send confidential information through Feedback. We are not required to treat unsolicited Feedback as confidential.
13. Privacy
Our collection and use of personal information in connection with the Services is described in our Privacy Policy.
Privacy Policy: https://stupidshark.com/privacy-policy
The Privacy Policy describes our data practices. Consent to a particular processing activity, where required, is requested separately.
Where consent is legally required for a particular type of data processing, advertising, notification, or device permission, we will request it through an appropriate notice or platform mechanism.
14. Support communications
You may contact us at support@stupidshark.com for reasonable support concerning the Services.
When contacting support, provide only information reasonably necessary to investigate the issue. Do not send passwords, full payment-card details, identity documents, or other highly sensitive information unless we specifically and lawfully request it through a secure method.
We may retain support communications as described in the Privacy Policy and as necessary to respond, prevent fraud, protect legal rights, or comply with law.
We do not guarantee a particular response time, resolution, compensation, refund, or restoration unless required by applicable law.
15. Suspension and termination
You may stop using the Services at any time by uninstalling the application and discontinuing access.
To the extent permitted by applicable law, we may restrict, suspend, or terminate your access to all or part of the Services if:
-
you materially or repeatedly breach these Terms;
-
we reasonably suspect fraud, abuse, unlawful activity, security threats, or purchase manipulation;
-
your use creates risk or harm to the Services, us, a third party, or other users;
-
a platform provider, court, regulator, or competent authority requires action;
-
continuing to provide the Services becomes unlawful or technically impracticable; or
-
the Services are discontinued.
Where reasonable and legally required, we will provide notice or an opportunity to contact us about the decision.
Termination does not affect rights or obligations that arose before termination. Sections that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, purchases, disclaimers, liability, disputes, and general legal terms.
Termination or discontinuation does not automatically entitle you to a refund except where required by applicable law or the relevant app-store policy.
16. Disclaimer of warranties
Nothing in these Terms excludes or limits any warranty, consumer right, or remedy that cannot be excluded or limited under applicable law.
Subject to those mandatory rights, the Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, availability, compatibility, accuracy, security, and non-infringement.
We do not warrant that:
-
the Services will always be available, uninterrupted, secure, or error-free;
-
defects or data loss will always be corrected;
-
the Services will work on every device or operating-system version;
-
gameplay progress or settings will never be lost;
-
advertisements, rewards, purchases, or third-party integrations will always function;
-
the Services will meet your personal expectations; or
-
the Services will be free from harmful components introduced by third parties outside our reasonable control.
The Services are provided for entertainment. Any descriptions of gameplay, difficulty, performance, or future features are informational and are not guarantees unless expressly stated as binding at the point of purchase.
17. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law or liability for intentional misconduct where exclusion is prohibited.
To the maximum extent permitted by applicable law, Stupid Shark and Kysliuk Dmytro Ivanovych will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of profits, revenue, business, opportunity, goodwill, anticipated savings, or data, arising from or connected with the Services.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:
-
the amount you paid directly for the Services during the twelve months immediately before the event giving rise to the claim; or
-
the equivalent of EUR 50 in the applicable local currency.
The exclusions and limits in this section apply regardless of the legal theory of liability, but only to the extent permitted by law.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the exclusions and limitations apply only to the maximum extent legally permitted, and your mandatory statutory rights remain unaffected.
18. Responsibility for unlawful use
To the extent permitted by applicable law, you are responsible for reasonably foreseeable losses, claims, or costs that we incur because of your intentional unlawful conduct, fraud, material breach of these Terms, infringement of another person’s rights, or malicious interference with the Services.
This section does not require a consumer to indemnify us beyond what is lawful, proportionate, and enforceable under the consumer-protection laws applicable to that consumer.
19. Events outside our reasonable control
We are not responsible for delay, interruption, or failure caused by events outside our reasonable control, including natural disasters, war, terrorism, civil unrest, governmental action, sanctions, labor disruption, power failure, telecommunications failure, app-store outage, internet failure, cyberattack, third-party platform failure, epidemic, pandemic, or failure of essential suppliers.
This section does not limit obligations that cannot be excluded under applicable law.
20. Governing law and disputes
These Terms and any non-contractual obligations arising from them are governed by the laws of Ukraine, without regard to conflict-of-law principles.
Before filing a legal claim, you are encouraged to contact us at support@stupidshark.com and provide a reasonable description of the issue. We will attempt in good faith to resolve the dispute informally.
Unless mandatory law provides otherwise, disputes that cannot be resolved informally will be submitted to the competent courts of Ukraine. Where territorial jurisdiction may lawfully be agreed, the parties agree to the competent courts serving Rivne Region, Ukraine.
If you are a consumer, nothing in this section deprives you of:
-
mandatory rights under the law of your country or region of habitual residence;
-
the right to bring a claim in another court where mandatory consumer law permits or requires it; or
-
access to a consumer-protection authority or dispute-resolution procedure available under mandatory law.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms to the extent its exclusion is legally permitted.
21. International use and mandatory consumer rights
The Services may be accessible in countries outside Ukraine. You are responsible for complying with laws applicable to your use of the Services.
If the law of your country or region grants you mandatory rights concerning digital content, digital services, refunds, cancellation, conformity, quality, availability, privacy, minors, or dispute resolution, these Terms do not limit those rights where they cannot legally be waived.
If a provision of these Terms conflicts with a mandatory consumer-protection rule applicable to you, the mandatory rule will prevail only to the extent of the conflict.
22. Changes to these Terms
We may update these Terms to reflect changes in:
-
the Services or business model;
-
legal, regulatory, platform, or security requirements;
-
third-party services;
-
purchasing, advertising, or technical functionality; or
-
our contact or operational information.
The updated Terms will display a new “Last updated” date. For material changes, we will provide notice through the Services, the applicable store listing, our website, or another reasonable method where required by law.
Updated Terms apply from the effective date stated in the notice or document. Your continued use of the Services after that date constitutes acceptance of the updated Terms, except where applicable law requires separate consent.
If you do not agree to an update, you must stop using the Services.
Changes will not retroactively reduce rights already acquired through a completed purchase where doing so would violate applicable law.
23. General legal provisions
23.1 Entire agreement
These Terms, applicable purchase descriptions, and any additional terms expressly presented for a particular feature form the entire agreement between you and us concerning the Services.
23.2 Order of precedence
If additional terms for a specific feature conflict with these Terms, the specific additional terms control for that feature. Mandatory applicable law always prevails where it cannot be waived.
23.3 Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, it will be enforced to the maximum lawful extent or modified only as much as necessary to make it enforceable. The remaining provisions will continue in effect.
23.4 No waiver
If we do not immediately enforce a provision or legal right, that does not waive our right to enforce it later.
23.5 Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where applicable law permits the transfer.
We may transfer or assign our rights and obligations in connection with a reorganization, business transfer, sale of assets, change of legal form, or transfer of the Services, provided that the transfer does not unlawfully reduce your mandatory consumer rights.
23.6 No partnership or agency
These Terms do not create an employment, agency, partnership, joint venture, franchise, fiduciary, or similar relationship between you and us.
23.7 Headings
Section headings are provided for convenience and do not affect interpretation.
23.8 Language
These Terms are written in English. We may provide translations for convenience. If translations conflict, the English version controls to the extent permitted by applicable law. Where local law requires another language version to prevail, that mandatory requirement will apply.
23.9 Electronic communications
You agree that notices and communications relating to the Services may be provided electronically, including through the application, an app-store listing, a website, or email where available, subject to applicable law.
